Candle Terms of Service

To use certain features of our Services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Our Services allow you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("User Content") between you and your partner. We understand and respect that this content is private and personal.

Private Image Sharing: All images and photos shared through our platform will remain private and will not be publicly displayed, distributed, or used in our marketing materials without your explicit consent. These images are intended to be shared only between you and your partner.

Limited License: You grant us the technical license necessary to operate the Services, including storing, backing up, and transmitting your content between you and your partner. This license allows us to provide, maintain, and improve our Services.

You represent and warrant that: (i) the User Content is yours or you have the right to use it, and (ii) the posting of your User Content on or through our Services does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

Candle is designed as a private space for couples. We collect and process certain data to provide, maintain, and improve our Services.

You agree not to use our Services:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation
• To impersonate or attempt to impersonate Candle, a Candle employee, another user, or any other person or entity
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of our Services, or which may harm Candle or users of our Services

Our Services and their original content (excluding User Content), features, and functionality are and will remain the exclusive property of Candle and its licensors. Our Services are protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Candle.

Some aspects of our Services may be provided for a fee. If you elect to use premium features, you agree to pay all applicable fees as described on our Services.

Subscriptions will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage your subscription and turn off auto-renewal by going to your account settings after purchase.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

We may terminate or suspend your account and bar access to our Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

If you wish to terminate your account, you may simply discontinue using our Services or contact us to request account deletion.

In no event shall Candle, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use our Services; (ii) any conduct or content of any third party on our Services; (iii) any content obtained from our Services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Your use of our Services is at your sole risk. Our Services are provided on an "AS IS" and "AS AVAILABLE" basis. Our Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Candle, its subsidiaries, affiliates, and its licensors do not warrant that a) our Services will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) our Services are free of viruses or other harmful components; or d) the results of using our Services will meet your requirements.

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.
